And you stand in responsibility for all things both as man and as woman, and therefore it shall also be kept
rightful in this wise if you enter into a bond (marriage) as well as if you are still without a partner (unmarried);
therefore whether in a bond (marriage) or in the unmarried state you bear the entire responsibility for every
and each thing that you do; and in the bond (marriage) it is both the woman and the man who bear complete
responsibility for the clan (family) and therefore the descendants as well as for the hearth (household) and possessions and wealth; and if everything is managed and created jointly then all parties have an equal right to all
possessions and wealth, but if the bond breaks apart then everything that has been created jointly shall fall
due in equal measure to the man and woman; if the man or woman brings his or her own possessions into
the bond (marriage) then every possession and the wealth shall be due commensurately (accordingly) to the
one who brought it with them as their own (goods brought with them), which shall also apply if the bond
(marriage) is dissolved; neither man nor woman shall be preferred in the responsibility and management of the
clan (family) and the descendants and the hearth (household) because the management and welfare of these
are in the responsibility of both, but it shall be that the more discerning party, man or woman, bears a heavier
responsibility than the less discerning party; and therefore it is rightful that both the man and the woman are
obedient to one another in responsibility and keep their joint secrets of the bond (marriage) in public and therefore do not talk with interveners (third parties) about it so that the confidentiality of the unity of the bonded
companions (marriage partners) may be retained; if however one bonded companion (married partner) behaves
with intractability or vice or pathological craving so that the bond (marriage) and the management of the clan
(family) and provision for the descendants and welfare of the hearth (household) suffer harm, then the jurisdiction shall make a choice (decision) about the reprimand so that the intractability, vice or pathological craving may be counteracted and resolved; and if the intractable party obeys and demonstrates throughout one
year that the evil has been rectified, then no further measures shall be sought against him or her; if, however,
it becomes apparent after one year that the choice (decision) and the reprimand are being contravened then
the jurisdiction shall impose a punishment involving confinement to a place of fulfilment of guidelines (secluded regions or islands) for a time of two years for coming to terms (healing/recovery); if the fulfilment of measures (punishment by separation from society for a certain time) does not yield any benefit (success) then the
bond (marriage) shall be dissolved so that the harm and destruction of the clan (family) does not continue to
grow. |

Und in Verantwortung für alle Dinge steht ihr sowohl als Mann wie auch als Weib, und so sei
es auch des Rechtens in dieser Weise gehalten, wenn ihr in einem Bündnis (Ehe) einhergeht, wie
aber auch, wenn ihr noch unbemannt und unbeweibt (unverheiratet) seid; also tragt ihr in
einem Bündnis (Ehe) wie auch im Unvermähltsein die umfängliche Verantwortung für alles und
jedes, was ihr auch immer tut; und im Bündnis (Ehe) sei sowohl das Weib wie auch der Mann
in die umfängliche Verantwortung für das Geschlecht (Familie) und also die Nachkommenschaft
und für den Herd (Haushalt) und den Besitz und Reichtum eingesetzt; und wird alles gemeinsam
geführt und geschaffen, dann gebührt aller Besitz und Reichtum gemeinsam, doch geht das
Bündnis auseinander, dann gebührt alles gemeinsam Erschaffene jedem, Mann und Weib, zu
gleichen Anteilen; wird vom Mann oder Weib eigener Besitz und Reichtum ins Bündnis (Ehe)
eingebracht, dann gelte jeder Besitz und Reichtum angemessen (gemäss) dem, wer ihn als
eigene Bescheidung (mitgebrachtes Gut) mitgebracht hat, was auch so bleibe, wenn das Bündnis (Ehe) aufgelöst wird; weder Mann noch Weib soll in der Verantwortung und Führung des
Geschlechts (Familie) und der Nachkommenschaft und dem Herd (Haushalt) vorgezogen sein,
denn deren Führung und Erhalt und die Versorgung liegt in der Verantwortlichkeit beider, doch
soll es sein, dass der klügere Teil, Mann oder Weib, mehr Verantwortung trage als der weniger
kluge Teil; und also sei es des Rechtens, dass sowohl der Mann wie auch das Weib einander in
Verantwortlichkeit gehorsam sind und ihre gemeinsamen Geheimnisse des Bündnisses (Ehe)
nach aussen wahren und also nicht mit Eindringenden (Dritten) darüber reden, auf dass die Vertrautheit der Einigkeit der Bündnisgefährten (Ehepartner) gewahrt bleibe; ist aber von einem
Bündnisgefährten (Ehepartner) Widerspenstigkeit oder Laster oder Sucht gegeben, auf dass das
Bündnis (Ehe) und die Führung des Geschlechts (Familie) und die Versorgung der Nachkommen
und der Erhalt des Herdes (Haushalt) Schaden leiden, dann soll durch die Gerichtsbarkeit eine
Erwählung (Beschluss) ergehen zur Anordnung (Massregelung), dass die Widerspenstigkeit, das
Laster oder die Sucht bekämpft und aufgelöst werden; und wenn der widerspenstige Teil gehorcht und während eines Jahres nachweist, dass das Übel behoben ist, dann soll kein weiterer
Weg wider ihn gesucht werden; ergibt sich jedoch nach einem Jahr, dass der Erwählung (Beschluss) und der Anordnung (Massregelung) zuwidergehandelt wird, dann soll eine Ahndung
durch die Gerichtsbarkeit erfolgen, auf dass an einem Massnahmeerfüllungsort (abgelegene
Landstriche oder Inseln) eine Zeit von zwei Jahren zum Beikommen (Heilung/Genesung) verbracht werde; bringt die Massnahmeerfüllung (Ahndung durch Aussonderung aus der Gesellschaft für eine bestimmte Zeit) keinen Nutzen (Erfolg), dann soll eine Auflösung des Bündnisses
(Ehe) erfolgen, auf dass der Schaden und die Zerstörung des Geschlechts (Familie) nicht weiter
um sich greife. |
